Registration of Nursing Agencies with South African Nursing Council
Purpose of the circular In the past, Nursing Agencies were registered with the South African Nursing Council (SANC) in terms of the provisions in the Nursing Act, 1978 (Act No. 50 of 1978). Contrary to that, the new Nursing Act, 2005 (Act No. 33 of 2005) has no provisions for registration of Nursing Agencies by the South African Nursing Council . The provisions for establishment and regulation of Nursing Agencies is contained in Section 36 of the National Health Act, 2003 (Act No. 61 of 2003) while the Nursing Act, 2005 (Act No. 33 of 2005) does not have provisions for the South African Nursing Council to continue with the regulation of Nursing Agencies. In light of the above, both the South African Nursing Council and the National Department of Health are engaged in discussions to find an amicable solution on this matter. You shall therefore be informed of the new processes pertaining to registration of Nursing Agencies in compliance with the National Health Act, 2003 (Act No. 61 of 2003) in due course.
